Sonaimuri seeks to regain property

A family in Sonaimuri has been deprived of their ancestral property of about 3 acres 36 centuries for many years. The family of Narayan Chandra of Kumargharia village in Dewati union of the upazila has to endure such oppression. They have even approached the court to regain their ancestral land and deposits.

Although the family has won the court’s verdict after a long legal battle, they have not been able to take possession of their ancestral property due to fear of muscle power. Recently, there has been another incident of seizing their land and building a pucca house. The victim, Narayan Chandra Guha, has filed a written complaint with the Sonaimuri police station in this regard.

According to the complaint, Narayan Chandra Guha is the ancestral owner of 100 percent of the property of the house at 884 Dag No. 884, 194 Hale, 37 Kumargharia Mouza, Sonaimuri. On January 29, 2025, at around 2 pm, the sons of the deceased Sultan Ahmed, Md. Helal, Suman, Saddam, Mahasin, Momin Gangra, were constructing a pucca house and toilet on that land. Earlier, due to a dispute over the land, Narayan Chandra Guha filed a civil case No. 303/2006 in the district’s Bijna Sadar Additional Assistant Court as the plaintiff. The court reviewed the plaintiff’s documents in the case and gave a verdict.

Even then, the victim family could not take possession of their property. Although the village shalis were consulted several times on the matter, Helal Gangra did not accept the verdict of the shalisdars. Narayan Chandra Guha complained that he was the son of the deceased Pramod Ranjan Guha of Deoti Union of the upazila. Even after they got a court verdict in their favor in a land case, the encroachment group did not release the property.

After August 5, the encroachment group became reckless. When Helal Gangra tried to stop the construction of a mud house and toilet on the property, the members of the encroachment group threatened to intimidate and leave the area. They are currently suffering from insecurity. In this regard, he has filed a written complaint with the police station, making 13 people defendants. This property belongs to their ancestors. Local encroachments have seized a large amount of property by making fake papers. Although they have legal documents for their ancestral land, they are helpless as they are only a minority community. When they went to the public land, Narayan Chandra Debnath, an elder of Kumar Gharia village, said that Helal Gangra has continued to file cases and attacks against them over property disputes. They are trying to liberate their area. Even though the court verdict and eviction case are pending, they have continued to occupy it. They are threatening in various ways.

According to the case file in the court, the organized gang of Kumargaria village prepared 4 fake documents. On the basis of those documents, they seized several properties of Narayan Chandra. In 1988, Narayan Chandra’s family filed a case in the Sub Judge’s Court to cancel the document. On May 23 of that year, the Sub Judge’s Court issued a temporary ban on the land. Later, on October 16, 2000, it declared the four documents of 3 acres 36 decims of land claimed by the disputing party as fake.

An elderly minority of Kumargaria village said, “The case has been going on for a long time regarding this land. The miscreants even set fire to Narayan Chandra’s house once over this incident. The family’s financial condition has deteriorated a lot due to the long litigation. Although the Narayans got the land in the verdict of the case, they are not able to take possession of the land due to fear of being a minority Hindu community.

Sonaimuri Police Station Officer-in-Charge (OC) Morshed Alam said, “We have received a written complaint regarding the encroachment of property belonging to the Hindu community. The matter has been assigned to the police station’s SI Mithun Chandra Shil. Legal action will be taken after the investigation.”
