Since independence, the people of the country have always seen almost every election as questionable. Many political parties have run the country without holding acceptable elections many times. Except for a few elections, the people have rejected all elections. Many people of the country have lost their lives in almost every election. While the election was festive for one side, it was painful and tragic for the other. The riots between clans surrounding the election were a normal scene in Bengal. There is no festive atmosphere in the election, the election is a part of the state and the responsibility of the citizen. It is everyone’s expectation that honest, idealistic, ethical and universally acceptable people will be elected through the election and achieve the development of the people. Through whom the countrymen will receive the gift of a good social system and a state. An acceptable election and the formation of an independent election commission for acceptable elections are needed. The steps that are very important to form an independent election commission and make the election acceptable are that the President will form a search committee consisting of three judges.
Since the head of government comes from a political party, the head of government appoints a person of his choice as the Secretary of the Election Commission and the head of government assures the Secretary of the Election Commission of a good post as a reward if he works for his political party. As a result, the Secretary of the Election Commission is influenced. For example, Jahangir Alam, the Secretary of the Election Commission of the 12th Parliament ’24, was made the Secretary of the Home Affairs as a reward for conducting a black election. Therefore, in order to keep the formation of a completely independent Election Commission free from government interference, the Secretary of the Election Commission will be appointed by the Commission through promotion from the Election Commission Division. In order to form an independent Election Commission and keep it free from government interference, the Secretary of the Election Commission cannot be given from the Executive Division of the Government in any way.

With the announcement of the election schedule, just as all the officials of the country’s administration will be under the Election Commission, all the other officials except the only Deputy Commissioner will be under the District Election Officer and in the case of Upazila, all the officials of the Upazila except the Upazila Nirbahi Officer will be under the Upazila Officer. Since there is its own branch or organization for the election and to keep it free from the pressure of the executive department and the government, the District Election Officer will serve as the District Returning Officer and the Upazila Election Officer will serve as the Assistant Returning Officer. The Deputy Commissioner and the Upazila Executive Officer will be completely free from the election. For the sake of the election, the District Election Officer can transfer any officer of any upazila under the district. If any officer who will be responsible for the election has been working in any upazila for three years, he must be transferred to another upazila. However, if necessary for special family reasons, the Deputy Commissioner can later transfer him to that upazila. As a returning and assistant returning officer, the District and Upazila Election Officer should be given magisterial powers to control various types of irregularities, corruption crimes in the election and the District Election Officer will be empowered to give any punishment to any government officer or employee, presiding, assistant presiding, due to negligence or irregularities in the election duties. If any aggrieved candidate participating in the election is not satisfied with the judgment of the District Election Officer, he can approach the court.

Since officials and employees were not punished for negligence or irregularities in past elections, they did not fulfill their duties properly in the elections and worked in favor of influential candidates. Therefore, a policy should be formulated to punish officials and employees for negligence or irregularities in elections.
